Terms of Service

BuyCarsLocally.com ("BuyCarsLocally," "we," "us," or "our") is an online marketplace platform based in Texas. We provide technology that connects independent car dealers ("Dealers") with prospective car buyers ("Buyers"). BuyCarsLocally is not a car dealer, does not sell vehicles, and is not a party to any vehicle transaction.

We do not own, inspect, warrant, or guarantee any vehicle listed on our platform. All listings are created and controlled by independent Dealers who are solely responsible for their accuracy, completeness, and compliance with applicable law.

You must be at least 18 years of age to use this platform. By using BuyCarsLocally you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

BuyCarsLocally provides:

• A searchable directory of vehicle listings submitted by participating Dealers.
• A lead submission form that forwards your contact information to a Dealer when you request availability.
• Location-based search tools to help you find vehicles near you.
• Dealer profile pages with contact information, hours, and inventory.

BuyCarsLocally does not:

• Set, negotiate, or guarantee vehicle prices.
• Certify, inspect, or warrant the condition of any vehicle.
• Process payments or handle any part of a vehicle transaction.
• Employ or supervise Dealers or their staff.
• Guarantee the accuracy of mileage, vehicle history, title status, or any other listing detail.

Any transaction you enter into with a Dealer is solely between you and that Dealer. We encourage you to independently verify all vehicle information, obtain a vehicle history report, and have the vehicle inspected by a qualified mechanic before purchase.

As a Buyer using BuyCarsLocally, you agree to:

• Provide accurate contact information when submitting a lead.
• Use the platform only for lawful purposes related to researching or purchasing a vehicle.
• Not submit false, misleading, or fraudulent inquiries.
• Not use automated tools, bots, or scrapers to access platform data.
• Understand that submitting a lead form constitutes consent to be contacted by the Dealer whose listing you inquired about.

Dealers who list inventory on BuyCarsLocally agree to:

• Provide accurate, current, and complete vehicle listings including pricing, mileage, condition, and photos.
• Remove or update listings promptly when a vehicle is sold or its status changes.
• Comply with all applicable federal, state, and local laws governing the sale of motor vehicles, including FTC Used Car Rule disclosures.
• Not list vehicles they do not have a legal right to sell.
• Respond to all buyer inquiries within 2 business days of receipt.
• Not use buyer contact information for any purpose other than responding to a specific inquiry.
• Maintain all required dealer licenses and bonds for their state of operation.

BuyCarsLocally reserves the right to remove any listing or suspend any Dealer account that violates these terms, contains false information, or generates complaints from buyers, without prior notice.

No Endorsement. Inclusion of a Dealer on BuyCarsLocally does not constitute an endorsement, certification, recommendation, or warranty by BuyCarsLocally of that Dealer, its vehicles, business practices, licensing status, or financial stability. Buyers should conduct their own due diligence before transacting with any Dealer.

Current Pricing. Dealer listings are currently provided at no charge. BuyCarsLocally reserves the right to introduce fees in the future with advance notice. If paid plans are introduced, separate billing terms will be published and will govern those arrangements.

When you submit a contact form or availability request on a vehicle listing page, your name, email address, phone number (if provided), and message are transmitted directly to the Dealer associated with that listing. By submitting this information you expressly consent to being contacted by that Dealer regarding the vehicle you inquired about, including by phone and email.

BuyCarsLocally does not sell your contact information to third parties, advertising networks, or lead aggregators. Your information is shared only with the specific Dealer you contacted. See our Privacy Policy for full details.

You may not use this platform to:

• Post false, deceptive, or misleading vehicle listings or inquiries.
• Harass, threaten, or harm any Dealer, Buyer, or platform employee.
• Circumvent or attempt to circumvent any security feature of the platform.
• Scrape, copy, or republish platform content without written permission.
• Violate any applicable law, regulation, or third-party right.
• Transmit spam, malware, or any harmful code.
• Impersonate any person or entity.

All platform content, design, trademarks, software, and technology are the property of BuyCarsLocally or its licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

Dealers retain ownership of their listing content (photos, descriptions) but grant BuyCarsLocally a non-exclusive, royalty-free license to display that content on the platform and in marketing materials.

DMCA Copyright Notice. BuyCarsLocally respects the intellectual property rights of others. If you believe that content on our platform infringes your copyright, please send a written notice to support@buycarslocally.com with the subject line "DMCA Takedown Request" including:

• A description of the copyrighted work you claim has been infringed.
• The URL or location on our platform where the infringing content appears.
• Your name, mailing address, phone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We will review all valid notices and remove infringing content promptly. Repeat infringers may have their accounts terminated.

The platform may contain links to Dealer websites and third-party services. We do not control, endorse, or assume responsibility for any third-party content, privacy practices, or terms. Your use of any third-party site is at your own risk.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY LISTING INFORMATION IS ACCURATE, COMPLETE, OR CURRENT; (C) ANY VEHICLE IS IN THE CONDITION DESCRIBED; OR (D) ANY DEALER IS LICENSED, BONDED, OR TRUSTWORTHY. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE PLATFORM AND ANY TRANSACTION WITH A DEALER.

Listing Accuracy. Vehicle listings on BuyCarsLocally may contain typographical errors, pricing errors, delays in updates, or outdated availability information. Listing data is supplied by Dealers and may not reflect real-time inventory status. BuyCarsLocally makes no representation that any listing is free from error.

Availability Not Guaranteed. Vehicles may be sold, pending sale, or removed from inventory before listing updates occur. Always confirm vehicle availability, pricing, and condition directly with the Dealer before visiting the lot or making any purchasing decision.

TO THE FULLEST EXTENT PERMITTED BY LAW, BUYCARSLOCALLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY VEHICLE TRANSACTION WITH A DEALER, INCLUDING DISPUTES RELATED TO FINANCING, WARRANTIES, TITLE ISSUES, SHIPPING, OR VEHICLE CONDITION; (C) ERRORS, INACCURACIES, PRICING ERRORS, OR DELAYS IN LISTING INFORMATION; OR (D) UNAUTHORIZED ACCESS TO YOUR DATA.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

You agree to indemnify, defend, and hold harmless BuyCarsLocally and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your vehicle listings or lead inquiries; or (d) your violation of any third-party right.

We may suspend or terminate your access to the platform at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the platform at any time. Sections 8 through 14 survive termination.

These Terms are governed by the laws of the State of Texas without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.

Any claim must be brought within one (1) year of the event giving rise to the claim, or it is permanently barred.

We may update these Terms at any time. When we do, we will update the Effective Date above. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
